1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Gamable ("Service"), an AI-powered mobile game generation platform operated by Gamable ("Company", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Gamable is a platform that enables users to generate playable mobile games through AI-powered natural language prompts. The Service includes:

• Credit-based game generation system
• Browser-based game preview and testing
• Game code export functionality
• APK generation for Android devices (when available)
• Access to previously generated games

3. Account Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use

3.2 Age Requirements

You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have parental or guardian consent.

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Credit System and Payments

4.1 Credit Purchase

• Credits are purchased through our payment processor (Stripe)
• Credits are non-transferable and have no cash value
• Credit packages are clearly displayed with pricing before purchase
• All payments are processed securely through Stripe

4.2 Credit Usage

• Each game generation consumes a specified number of credits
• Credit consumption is clearly displayed before generation
• Generated games remain accessible regardless of remaining credit balance
• Credits do not expire unless otherwise stated

4.3 Pricing

We reserve the right to modify pricing at any time. Price changes will not affect credits already purchased.

4.4 Referral Credits

• When someone plays a game you shared, creates their own Gamable account, verifies their email and makes their first game, you receive free credits. Your first such referral also lets a free account keep building.
• Referral credits are limited to 10 referrals per 30 days, have no cash value and cannot be transferred or exchanged
• Only one account per person and per email inbox is allowed. Referrals involving your own accounts, automated sign-ups or any other abuse earn nothing, and we may remove credits obtained that way or suspend the accounts involved
• We may change or end the referral program at any time; credits already received stay on your account

5. User Content and Generated Games

5.1 Your Input

You retain all rights to the prompts and descriptions you provide to generate games. By using the Service, you grant us a license to use your input solely to generate and provide the requested games.

5.2 Generated Games

• You receive a non-exclusive license to use games generated through the Service
• Generated game code may incorporate AI-generated content and open-source components
• We do not guarantee the uniqueness of generated games
• You are responsible for ensuring any commercial use of generated games complies with applicable laws and third-party rights

5.3 Content Restrictions

You agree not to generate content that:

• Infringes on intellectual property rights
• Contains harmful, offensive, or illegal material
• Violates any applicable laws or regulations
• Impersonates others or misrepresents affiliation
• Contains malware or malicious code

6. Intellectual Property

6.1 Service Ownership

The Service, including its software, design, features, and underlying technology, is owned by Gamable and protected by copyright, trademark, and other intellectual property laws.

6.2 Trademarks

"Gamable" and associated logos are trademarks of the Company. You may not use these without prior written permission.

6.3 Feedback

If you provide feedback or suggestions about the Service, we may use them without any obligation to you.

7. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code or malware
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated tools to access the Service without permission
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without authorization
• Generate excessive requests that burden our systems

8. Service Availability and Modifications

8.1 Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to:

• Modify or discontinue features at any time
• Update these Terms with notice to users
• Change pricing with advance notice
• Implement usage limits or restrictions

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 AI-Generated Content

• We do not guarantee the quality, functionality, or suitability of generated games
• Generated games may contain errors or require modification
• We are not responsible for how you use generated games
• AI models may produce unexpected or unintended outputs

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMABLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

10. Indemnification

You agree to indemnify and hold harmless Gamable, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you generate or submit

11. Third-Party Services

The Service integrates with third-party services including:

• Payment processing (Stripe)
• AI generation services
• Hosting and infrastructure providers

We are not responsible for third-party services or their terms and policies.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law provisions.

12.2 Arbitration

Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration in Göteborg, Sweden.

12.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Export Compliance

You agree to comply with all applicable export and import laws and regulations when using the Service or generated games.

15. Children's Privacy

The Service is not directed to children under 13. We do not knowingly collect information from children under 13 without parental consent.

16. Termination

16.1 Your Rights

You may terminate your account at any time by contacting us. Termination does not entitle you to a refund of unused credits unless otherwise stated in our Refund Policy.

16.2 Our Rights

We may suspend or terminate your access immediately for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service
• Non-payment
• Any other reason at our discretion

16.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and content
• Provisions that by nature should survive will remain in effect

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Gamable.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

17.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.

17.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
